WV ABCA License for Huntington, WV Restaurants and Bars Planning to Borrow

In West Virginia, alcohol licenses come from the Alcohol Beverage Control Administration (ABCA). For a Huntington, WV restaurant or bar financing a kitchen, a bar build-out or a purchase, the license is part of what a funding partner may check, because without it the sales that repay the money stop.

WV ABCA License Application: Where It Sits in a Restaurant Funding File

The ABCA's FAQ lists six steps to an alcohol license: send the completed application; a licensing specialist reviews it for accuracy and completeness; the specialist asks for anything missing; an ABCA agent meets the applicant at the premises for an initial inspection, so the premises must be ready and construction complete; the application goes to final review for approval or denial; and an approved license is mailed and must be posted prominently.

The ABCA says the process takes about a month, depending on how complete the application is and how ready the premises are. For a funding file, the order matters: if the money pays for the build-out the inspection depends on, the build-out has to finish before the license can follow, and sales that depend on alcohol start after that.

The licensing page says an applicant generally needs good standing with the State Tax Department, WV Workers' Compensation, WV Unemployment and the Secretary of State, registration with the Secretary of State, and a completed application with a floor plan. Inside a city, the city completes the applicant's zoning form, according to the FAQ.

WV ABCA License Search: How a Lender Confirms the License Is Active

The ABCA's license search looks up licenses by business name, representative, city, license number, license type and county, including Cabell and Wayne, and shows status (active, cancelled, expired, inactive, probation, revoked, suspended), issue and expiration dates and partner information. The ABCA FAQ says the search is updated daily.

A partner financing a bar or a restaurant with bar sales may run that search or ask the business for a copy. Running it first, and saving the result, answers the question before it is asked.

WV ABC License Renewal Dates and Equipment Loan Timing

The ABCA renewal process uses a preprinted renewal form mailed to licensees, and the renewal application must reach the ABCA before the fee is paid online, according to its renewal payment page. A $150 reactivation fee applies to licensees that renew late, and an operational fee of $100 is added for each licensed location, the licensing page says.

The expiration date for a specific license shows in the license search. For an equipment loan, check that the license will be current through the first months of payments, and renew early if a renewal falls during a build-out.

West Virginia Alcohol License Types a Restaurant or Bar May Hold

Most West Virginia licenses fall into two types, the ABCA says: Class A for on-premises consumption and Class B for off-premises consumption. Class A types listed on the licensing page include the private club bar or private club restaurant (annual fee $1,150 for fewer than 1,000 members and $2,650 for more), private wine restaurant licenses, tavern licenses for nonintoxicating beer and brew pubs, along with hotels, caterers, food trucks and outdoor areas. Class B covers off-premises items such as growlers and delivery permits.

Which type a business needs depends on what it sells and how; the ABCA licensing division decides. A partner reads the license type mainly to understand which sales it supports.

Ownership Changes, Buyouts and the ABCA Notice

The ABCA FAQ says a licensee must contact the ABCA immediately, before or as soon as any change is made, when owners, ownership structure or partners change, and warns of penalties for hidden ownership, including revocation. That bears directly on buying a bar or restaurant, or buying out a partner in one.

A buyer's lender may want to see that the ABCA has been contacted and how the license will be held after closing. The article on buying a business covers the other city and state steps on a change of owner.

Patios, Outdoor Areas and Floor Plans in a Bar Upfit

Patrons may drink only in areas the ABCA has approved on the licensee's floor plan, according to its FAQ, and some outdoor areas can qualify for licensure. A patio, a rooftop or an expanded dining room changes the floor plan, so a build-out financed for that purpose should include the ABCA approval in its timeline.

The city also issues Outdoor Dining Permits for dining areas on the public right-of-way, per its business license page. The equipment page covers bar equipment such as draft systems and coolers, and the restaurant page covers kitchen funding.
